A home is the biggest purchase most people ever make, we believe it is important to offer you, the original purchaser a warranty on your new home. We take a great deal of pride in the homes we sell, and we want to back up the workmanship and materials that have gone into its construction.

We also want to make sure that you, the purchaser, and Skirig Development Inc. (SDI) the builder, are both clear about the details of coverage provided by this warranty.


WARRANTY, QUALITY AND STANDARDS

INTRODUCTION
This warranty guarantees that we will provide you with reasonable service in correcting defective materials or workmanship in your new home, as specified by the terms of this warranty. This document is an express warranty, which means that it details your coverage; explains who is covered; outlines the limits of coverage, and tells you how to make a claim, if necessary. Referred to as a warranty, this document is actually several warranties on various parts of your home. Each warranty is addressed individually in the body of this document.

The consumer items included in the sale of the home, such as, but not limited to, the dishwasher, refrigerator, stove, furnace and garbage disposal are warranted by their manufacturers. If items of this nature are defective, the manufacturers, not SDI are responsible for the repair of or replacement of the defective items or parts of items. (See, "Defective Appliances and/or Equipment"). SDI makes no express or implied warranties regarding items of this nature, including, but not limited to warranties or merchantability or fitness for a particular purpose.

WHO IS COVERED
This warranty protects you, the original purchaser, while you own the home. The specific warranty periods are noted in the following section. The warranty cannot be transferred to anyone else.

HOW LONG ARE YOU COVERED
Your coverage for the items contained in this warranty begins at the time of closing. The duration of each warranty is one year, unless specified herein. Some of the warranties are for less time. Warranty periods are outlined in the section "What Are You Covered For?"

The warranties will terminate automatically when either of the following first occurs: You sell your home or the warranty period specified in the applicable section herein expires.

If SDI corrects a defect or performs any repair outside the scope of the warranty or not required by the warranty, such action cannot be deemed as either accepting responsibility for the defect or need for repair or extending any warranty period(s).

The standard warranty period is for one year except as otherwise specified herein. Exceptions to the stated warranty follow in the body of this document. SDI specifically does not warranty the furnace or air-conditioning unit or any other portion of the heating and cooling system, which carries an express warranty from its manufacturer. (See, "Defective Appliances and/or Equipment.")

Items Noted Before Occupancy

Before you move into your new home, you will customarily be asked to make a "walk through" inspection, at which time you should carefully note any of the deficiencies noted later in this paragraph. This inspection will ensure that you and SDI agree on whether a problem or deficiency existed prior to or after your closing.

Deficiencies to be noted at time of your walk through are as follows:

  • Defects of or on painted surfaces and countertops.
  • Chipped porcelain or tile.
  • Chipped or defective surfaces of or on appliances and/or plumbing fixtures.
  • Torn, defective or missing screens.
  • Defects in carpets and/or other floor coverings.
  • Defects in wall coverings.
  • Defects in cabinet surfaces or finishes.
  • Broken windows or mirrors.
  • Any defects or damage of the same or of a similar nature, which is not referenced specifically herein, but which you believe should be brought to the attention of SDI.

Warranty: The above referenced deficiencies, defects and/or damage will be corrected by SDI under the following conditions; the deficiencies, defects and/or damage are/is readily visible; the deficiencies defects and/or damage exceed(s) industry standards or normal production tolerances; and the deficiencies, defects and/or damage were/was noted in writing and reported to a representative of SDI during the "walk through" inspection.

Warranty Period: In order to be addressed by the builder, items such as those referenced above must be reported at the time of "walk through inspection". Reasonable dates for addressing deficiencies, defects and/or damage as noted in this section, will be established by the buyer and the builder. If a third party such as, but not limited to, a supplier must be involved in replacing, repairing and/or rectifying a stated deficiency, defect and/or damage, the buyer and builder acknowledge that the dates agreed upon for addressing/completing items covered by this section may have to be extended.

Exception: SDI will not repair hairline cracks, wood cracks or minor separation of grouting. These exceptions are more fully detailed in "What is Not Covered".

Minor Repairs and Adjustment After Occupancy

Warranty: SDI will make certain other minor repairs and adjustments only if you report them to a representative of SDI not later than sixty (60) days after your closing. Examples of such repairs and adjustments are, sticking doors, but not if you install or have installed your own carpeting, cabinet drawer and door adjustments. Whether an item is of the nature intended to be covered by the provisions of this section is at the sole discretion of SDI.

Warranty Period: Sixty (60) days from the date of closing.


WHAT IS COVERED

SDI will correct defective materials and/or workmanship in the structural components of the home, within the limits set forth in this document. Structural components mean items such as, but not limited to; the walls, floors, ceilings, roof, cabinets, shelves, floor and wall coverings, closets, patios, balconies, bathroom fixtures, railings, planters, shingles, gutters, windows, ducting, wiring and pipes. The items provided in this section as structural components are merely examples and are not to be deemed as a representation that the home includes all such items.

The Roof

Warranty: SDI warrants that the roof and flashings will be free from leaks and defects.

Warranty Period: One (1) year.

Exception: This warranty does not cover defects which occur because of acts or circumstances beyond the control of SDI. Acts of God or nature are not covered by this warranty, and acts done by you or a third party on your behalf, such as but not limited to, attaching a superstructure or television antennas to the roof are also excluded from the stated warranty.

The warranty of shingles, if any, will pass to the home owner.

Drains, Toilets and Faucets

Warranty: SDI warrants that the faucets will function and the drains will flow.

Warranty Period: Thirty (30) days from date of closing. (This covers toilets, faucets and drains).

Exception: Any deficiency, defect or damage to the drains, toilets or faucets caused by your use of the drains, toilets or faucets or the use of your drains, toilets or faucets by a third party and not caused by defective materials or workmanship will be your responsibility. In addition, any resulting damage to floors, ceilings or walls or to your personal property or the personal property of others resulting from you not addressing a deficiency, defect or damage caused by you or a third party using your drains, toilets or faucets will be your responsibility and you will be obligated to bear any costs associated therewith.

If SDI repairs any problem in the drains, toilets or faucets, which was caused by your use of your home or by the use of your home by a third party, and not by defective materials or workmanship, you will be billed for the cost of repair. In addition, in the event that SDI fixes any damage, defect or deficiency which is caused by your use of the drains, toilets or faucets or a third party's use of your drains, toilets or faucets, such action is not to be deemed as an admission of responsibility by SDI for the deficiency, defect or damage.

Grading

Warranty: SDI warrants adequate drainage of water away from your home.

Warranty Period: One (1) year.

Exception: SDI is not responsible for any drainage issues due to the fact that you or a third party has changed in any way the grade or draining pattern of the property.

Driveways

Warranty: SDI warrants that the driveway will be free from material defects under normal use. Normal use as used herein means pedestrian traffic and vehicular traffic by family automobiles or other vehicles of a similar weight.

Warranty Period: One (1) year.

Exception: SDI will not repair any damage which is caused by heavy trucks, heavy machinery or other unusual loads, unless the trucks, machinery or loads are directly related to SDI's construction of Rock Ridge Estates. Any damage of this or a similar nature caused by the home owner, the home owner's invitee or the home owner's agent will be the responsibility of the home owner.

Concrete and Masonry

Warranty: SDI warrants against all substantial defects to any and all stucco, concrete, brick, stone and other masonry in your home. "Substantial Defects" as used herein means any cracks which significantly interrupt the surface or which impairs the structural integrity of the item or part.

Electrical System

Warranty: SDI warrants the electrical system including all wiring, connections and electrical boxes.

Warranty Period: One (1) year, except for minor repairs and adjustments as defined below.

Exception: This warranty does not cover light bulbs.

Heating and Air Conditioning

Warranty: SDI warrants that the heating and air-conditioning system included in your home were installed in accordance with accepted heating and air-conditioning installation practices and meet inspection agency standards.


WHAT IS NOT COVERED

This section identifies those items or matters not covered by this warranty. Generally, these exclusions are problems which do not occur in the structural components of the home, are relatively minor and common in any and all structures, are caused by acts of God or nature or are due to other actions out of the control of SDI.

Home Owner's Repairs or Alterations
SDI is not responsible for any damage to your home, structural or otherwise, which is caused by the home owner, his invitee, his agent or any third party. SDI will not repair any portion of the home that the home owner, his invitee, his agent or a third party has modified. Modification as used in this document includes attempted or accomplished repairs.

Ordinary Wear and Tear and Catastrophes
SDI does not warrant any damage to your home caused by ordinary wear and tear. Similarly, but not limited to, earthquakes, hurricanes, floods and high winds are also not the responsibility of SDI. In addition, any damages caused by acts of war are not the responsibility of SDI.

Normal Maintenance
SDI is not responsible for any damages resulting from your failure to properly maintain your home or any components thereof. If SDI performs any maintenance at your home as the result of the "walk through inspection" this does not mean that the same or a similar repair or replacement will be made in the future.

Abusive Use
SDI will not be responsible to repair any damage caused by abuse of the home by the home owner or a third party. Similarly, SDI will not be responsible for any damage caused to the home, structural or otherwise, if it is determined by SDI in their sole discretion, that the damage to the structure, system or item is the result of or related to the improper use of the structure, system or item.

Hairline Cracks
SDI is not responsible for the repair of any hairline cracks in stucco, concrete, plaster, drywall, masonry, ceramic tile and/or any other rigid materials used in the interior walls and floors of the home and exterior walls of the home.

Imperfections in Wood
SDI will not repair wood cracks and minor openings of wooden joints, such as, but not limited to, paneled doors, mitered casings and solid paneling. Imperfections of this nature are generally caused by the normal "drying out" process of the materials used in the construction of your home. Also, SDI is not responsible for cracking, checking, twisting or turning of wood beams, unless this condition prevents the beam from meeting industrial structural standards.

Grouting
SDI will not repair minor separations of grouting for ceramic tile, synthetic marble, or other similar materials. The determination of whether a separation is minor will be made in the sole discretion of SDI.

External Painting
SDI is not responsible for fading, chalking or checking of outside paint caused by acts of nature. The home owner shall be responsible for all external maintenance.

Defective Appliances and/or Equipment
Appliances, equipment and other consumer goods are covered by warranties provided by the manufacturers. SDI will not provide any warranties regarding such items. With respect to any deficiencies, defects or damage to any appliances and/or equipment, the home owner must deal directly with the manufacturer. SDI upon request will assist the home owner in contacting the manufacturer.

Examples of items which are considered to be appliances, equipment and/or consumer goods follow; air conditioning system, barbecue grill, boiler, burglar alarm, central vacuum system, chimes, dishwasher, electric meter, electronic air cleaner, exhaust fan, fire alarm, fire extinguisher, freezer, furnace, garbage disposal, gas meter, heater pump, humidifier, ice maker, intercom, oven, oven hood, range, refrigerator, smoke detector, space heater, sump pump, thermostat, trash compactor, washer, dryer, water heater, water meter, water pump, water softener and whirlpool bath.

The items referenced above are provided merely as examples of items which SDI considers appliances, equipment or consumer goods there is no representation that any or all of the items are included in the home.

Shrubs, Trees or Plantings
SDI makes no representations or warranties as to the condition or the health of any shrubs, trees or plantings.


HOW TO MAKE A CLAIM
What to Do
If your home has a defect that is covered by this warranty, notify SDI in writing within the stated warranty period. Mail the claim to 500 Bridge Street, Groton, CT 06340 attention Leon Mularski.

Skirig Development Inc. Response
After written notice of a defect covered by this warranty is received by the appropriate party, a representative of SDI will decide whether to repair the defect or replace the defective item. In many cases a decision as to how to best address the claimed damage, defect or deficiency may require access to the home. Please also note that a decision as to whether the claimed damage, defect or deficiency falls under the scope of this warranty may also require access the home. A home owner making a claim will be contacted by a representative of SDI to schedule a mutually agreeable time to view the damage, defect or deficiency. If it is determined by a representative of SDI that the claimed damage, defect or deficiency falls within the scope of this warranty, repair or replacement of the item will be done within sixty (60) days. If acts of nature, weather conditions, labor issues or material shortages cause delays, the time for repair or replacement may be longer. If such is the case, the home owner will be notified of the delay by a representative of SDI.

The necessary work will be done by an employee of SDI or by a subcontractor chosen by them.

SDI is only responsible to repair or replace items that restore the home to the condition it was in when the damage, defect or deficiency occurred.

SDI is not responsible for payment of or to any employee or agent of the home owner for work done on or to the home.
